REGULATIONS OF THE ONLINE SHOP MILWORLD.PL
I. Definitions
The terms used in the Regulations mean:
1. Customer – a natural person, a legal person or an organizational unit without legal personality, to whom, special provisions confer legal capacity, and who submits Orders within the Store;
2. Civil Code – Act of 23 April 1964 (Dz.U. Nr 16, poz. 93 ze zm.);
3. Regulations – these Terms and Conditions of Electronic Services within the MILWORLD.PL online store;
4. Online Shop (Shop) – an internet service available at MILWORLD.PL, through which the Customer may in particular place Orders;
5. Merchandise – products presented at the Internet Shop;
6. Sales agreement – Contract of Sale of Goods within the meaning of the Civil Code, concluded between Tryskotech Tomasz Trysko and the Customer, concluded with the use of the Shop's Internet site;
7. Consumer Rights Act – Act of 30 May 2014 on consumer rights (Dz.U. z 2014 r. poz. 827);
8. Act on the provision of electronic services – Act of 18 July 2002 on providing services by electronic means (Dz. U. Nr 144, poz. 1204 ze zm.);
9. Order – statement of the will of the Customer, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods.
II. General provisions
2.1. These Regulations set forth the rules for using the online store available at MILWORLD.PL.
2.2. These Regulations are the regulations referred to in art. 8 of the Act on providing services by electronic means.
2.3. The Internet shop, operating under the name MILWORLD.PL, is run by Tryskotech Tomasz Trysko.
2.4. These Regulations specify in particular:
a) rules of registration and use of the account within the online store;
b) terms and conditions for electronic booking of products available through the online store;
c) terms and conditions of electronic submission of Orders within the online store;
d) rules for concluding Sales Agreements with the use of services provided within the Online Shop.
2.5. Using the online shop is possible provided that the ICT system used by the customer meets the following minimum technical requirements:
a) Internet Explorer version 9.x or later with Java enabled, or
b) Google Chrome version 40.x or later with Java enabled,
c) minimum screen resolution 800 x 600 pixels.
2.6. In order to use the online store, the Customer should, on his own, obtain access to a computer station or terminal, with access to the Internet.
2.7. In accordance with applicable law, Tryskotech Tomasz Trysko reserves the right to limit the provision of services through the Internet Shop for persons over the age of 18 years. In this case, potential Customers will be notified of the above.
2.8. Customers can get access to these Terms at any time via the link on the MILWORLD.PL homepage and download and print it.
2.9. Information about the Goods given on the website of the Shop, in particular their descriptions, technical and utility parameters and prices, constitute the invitation to enter into an agreement within the meaning of art. 71 Civil Code.
III. Terms of Use of the Online Shop
3.1. The condition to start using the Online Store is to register within it.
3.2. Registration is made by completing and accepting the registration form, which is available on one of the Shop pages.
3.3. The condition of registration is the consent to the content of the Regulations and the personal data marked as mandatory.
3.4. Milworld.pl may deprive the Customer of the right to use the Internet Store, and may restrict its access to some or all of the resources of the Online Shop, with immediate effect, in the event of violation of the Terms and, in particular, if the Customer:
a) during registration in the online store provided inaccurate, incorrect or outdated information, misleading or infringing the rights of third parties,
b) Has committed, through the online store, the infringement of personal rights of third parties, in particular the personal interests of other customers of the online store,
c) committed other behaviors that will be recognized by Tryskotech Tomasz Trysko for behavior contrary to applicable law or general Internet rules or undermine the good name of Tryskotech Tomasz Trysko.
3.5. A person who has been deprived of the right to use the online store cannot re-register without the prior consent of Tryskotech Tomasz Trysko.
3.6. In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Web Site, the Online Shop shall take technical and organizational measures appropriate to the security risk of the services provided, in particular measures to prevent the unauthorized acquisition or modification of personal data transmitted on the Internet.
3.7. The customer is obliged in particular to:
a) not provide or transmit content that is prohibited by law, such as content that promotes violence, defames or infringes on personal rights or other rights of third parties,
b) use the Online Store in a way that does not interfere with its operation, in particular by using specific software or devices,
c) not take action such as sending or posting unsolicited commercial information (spam) within the Online Shop;
d) use the Internet Store in a way that is not troublesome for other customers and for Tryskotech Tomasz Trysko,
e) use any content provided within the Online Shop only in the area of his or her personal use,
f) use the Internet Store in accordance with the law of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of the Internet.
IV. Procedure for conclusion of the Sales Agreement
4.1. In order to conclude the Sales Agreement via the Online Shop, please visit the MILWORLD.PL website, make a selection, take further technical steps based on the displayed messages and information available on the website.
4.2. Selection of Goods ordered by the Customer is made by adding them to the basket.
4.3. When ordering, until the "Order" button is pressed, the Customer has the opportunity to modify the entered data and to select the Goods. For this purpose, he should follow the displayed messages and information available on the website.
4.4. Once the Customer using the Internet Store has given all the necessary data, a summary of the Order will be displayed. It will include information about:
a) the object of the order,
b) the unit price and total price of ordered products or services, including delivery costs and additional costs (if any),
c) chosen method of payment,
d) chosen method of delivery,
e) time of delivery.
4.5. In order to send the Order, it is necessary to accept the content of the Regulations, give personal information marked as mandatory and press the button: "Order with payment obligation".
4.6. Sending the Order by Customer constitutes a statement of will to enter into a Sales Agreement with the [Store Operator] in accordance with the Terms and Conditions. 1
4.7. After placing the Order, the Customer receives an e-mail entitled Milworld - Confirmation of receipt of the order, containing the final confirmation of all relevant elements of the Order.
4.8. The agreement is treated as concluded when the Customer receives the e-mail mentioned above.
4.9. The Sales Agreement is concluded in Polish with the content in accordance with the Regulations.
V. Delivery
5.1. Delivery of Goods is limited to the territory of the Republic of Poland and takes place at the address indicated by the Customer during the Order submission.
5.2. Delivery of ordered goods is done by courier, InPost or Poczta Polska. Delivery costs are [exact shipping or a link to a page with details]. Additionally, delivery costs will be indicated at the time of placing the Order.
5.3. The delivery date is from 1 to 5 working days from the date of dispatch of the Order by the Customer.
5.4. Customers can get access to these terms at any time via the link on the MILWORLD.PL homepage and download and print it.
Solidification, securing, making available and confirming to the Customer the material terms of the Sales Agreement is done by sending a confirmation printout, Order Specification and VAT invoice to the Customer’s e-mail address, and also by attaching them to the package with the Goods.
VI. Prices and payment methods
6.1. The prices of Goods are quoted in Polish zloty and include all components, including VAT (with rates), duty and any other ingredients.
6.2. The customer has the possibility to pay the price:
a) by bank transfer to bank account number 44 1140 2004 0000 3102 7498 1427,
b) by IAI payment system or Transferuj.pl,
c) with MasterCard or Visa payment card supported by PayPal.
VII. Right to withdraw from the Sales Agreement
You have the right to withdraw from this contract within 30 days without giving any reason.
The deadline to withdraw from the contract expires after 30 days from the date of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us at "Tryskotech Tomasz Trysko, 40 Szubińska Str., 89-200 Rynarzewo, tel. 52 342 20 06, e-mail: sale@milworld.com about your decision to withdraw from this agreement by way of explicit declaration (for example, a letter sent by mail, fax or e-mail).
To keep the withdrawal deadline, you only need to send information about the exercise of your right to withdraw from the contract before the expiration of the withdrawal period.
Consequences of withdrawal
In the event of withdrawal from this agreement, we will refund all payments received from you, including the cost of delivery of the item (except for additional costs resulting from your choice of delivery other than the cheapest usual delivery method offered by us), promptly and in any case no later than 30 days from the date we were informed of your decision to exercise the right to withdrawal from this contract.
We will reimburse you using the same payment methods you used in your original transaction unless you have explicitly agreed otherwise. In any case you will not incur any charges in connection with this return. We may withhold payment until the item is received or until we receive a proof of return, depending on which event occurred earlier.
If the consumer has received items in connection with the contract:
Please return or transfer the item to us immediately, and in any event not later than 30 days from the date you informed us of your withdrawal from this contract. The deadline will be kept if you send back the item within 30 days.
a) You will have to bear the direct cost of returning the item.
b) If, reasonably, it is not possible to calculate the cost of return of the item beforehand: you will have to bear the direct costs of returning the goods. The amount of these costs is estimated at a maximum of approximately PLN 100.
VIII. Complaints about the Goods
8.1. Tryskotech Tomasz Trysko as a seller is liable to the Client who is a consumer within the meaning of Art. 22 [1] of the Civil Code, in respect of the warranty of defects in the scope defined in the Civil Code, in particular art. 556 and Art. 556 [1] - 556 [3] of the Civil Code.
8.2. Complaints arising from violation of the rights of the Customer guaranteed by law, or pursuant to these Regulations, should be addressed to sklep@milworld.pl. Tryskotech Tomasz Trysko undertakes to consider each complaint within 14 days, and if it is not possible, to inform the Customer during this period when the complaint will be processed.
8.3. Tryskotech Tomasz Trysko is not the manufacturer of the goods. The manufacturer is liable under the guarantee of the Goods sold, under the terms and for the period indicated in the warranty card. If the warranty document provides such an opportunity, the Customer can submit his / her warranty claims directly at an authorized service center which address is included in the warranty card.
IX. Complaints regarding the provision of services by electronic means
9.1. Tryskotech Tomasz Trysko takes steps to ensure the proper functioning of the Store, to the extent which it is based on current technical knowledge and undertakes to remove, within a reasonable time, any irregularities reported by the Customer.
9.2. The Customer is obliged to notify Tryskotech Tomasz Trysko of any irregularities or interruptions in the operation of the Internet Shop service immediately.
9.3. Irregularities related to the functioning of the Store may be reported by the Customer in writing to: Tryskotech Tomasz Trysko, ul. Szubińska 40, 89-200 Rynarzewo, by e-mail at sale@milworld.com or using the contact form.
9.4. In the complaint, the Customer should provide his / her name, mailing address, type and date of incorrectness associated with the functioning of the Store.
9.5. Tryskotech Tomasz Trysko undertakes to consider each complaint within 14 days, and if it is not possible, to inform the customer during this period when the complaint will be processed.
X. Final Provisions
10.1. Settlement of possible disputes arising between Tryskotech Tomasz Trysko and the Customer, who is a consumer within the meaning of art. 22 [1] of the Civil Code shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
10.2. Settlement of possible disputes arising between Tryskotech Tomasz Trysko and a Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code shall be submitted to the court competent for the seat of Tryskotech Tomasz Trysko.
10.3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on providing services by electronic means and other relevant provisions of Polish law shall apply.
